TERMS & CONDITIONS

BOAT SERVICE & CHARTER AGREEMENT

1. PURPOSE OF THE SERVICE

This agreement regulates the provision of the boat usage service during the time reserved by the client, including basic safety and navigation equipment, pre-boarding cleaning, and basic assistance during the activity. Depending on the contracted package, the service may include a skipper, insurance, and other additional services specified in the reservation.

2. SNACK SERVICE

Subject to prior contracting by the client

The snack service consists of a selection of light snacks intended for onboard consumption. Its content may vary depending on the contracted package and service availability.

  • The service includes exclusively one (1) soft drink and one (1) bottle of water per person.
  • Any additional consumption not included shall be paid for by the client.

3. RESPONSIBILITY FOR MINORS

Minors must remain under the supervision, care, and responsibility of the accompanying adults at all times. Said adults shall assume full responsibility for their safety, conduct, and well-being throughout the activity.

4. USE AND CARE OF EQUIPMENT

The client agrees to use the boat and all onboard equipment correctly, responsibly, and in accordance with staff instructions.

Liability: Any damage, breakage, loss, or deterioration resulting from improper use, negligence, or non-compliance with the rules shall be the sole responsibility of the client, who must assume the full cost of repair or replacement.

5. RULES OF CONDUCT ON BOARD

Appropriate, respectful, and safe behavior is required throughout the activity.

  • Alcohol Policy: Excessive alcohol consumption on board is strictly prohibited. The company reserves the right to terminate the service immediately in the event of non-compliance, without entitlement to any refund.
  • Cleanliness: Users must maintain the cleanliness and proper condition of the boat throughout the activity.
  • Tips: Gratuities are not included in the agreed price and are entirely voluntary.

6. PAYMENT CONDITIONS

The total amount of the service must be paid in full before the start of the activity, according to the previously agreed price. Boarding or commencement of the service shall not be permitted without full payment.

7. CANCELLATIONS AND NO-SHOW

The company may offer flexibility in reservation management when cancellation is due to exceptional circumstances or force majeure (adverse weather conditions, duly justified health issues, or other unforeseen situations).

  • In such cases, a change of date or another alternative solution may be offered, subject to availability.
  • In all other situations, reimbursement is not guaranteed unless expressly agreed in writing.
  • No-Show: Failure to appear at the agreed time shall result in the total loss of the service without entitlement to a refund.

8. ACCEPTANCE OF CONDITIONS AND CIVIL LIABILITY

The client declares that they have read, understood, and fully accepted the conditions of this agreement. Likewise, the client assumes civil liability for any damage caused to the boat, third parties, or themselves during the service, releasing the company from any liability arising from improper use of the service.

9. HANDLING AND RELEASE OF CATCHES

If the activity includes fishing practices, all catches must be handled in accordance with sustainability criteria and animal welfare.

  • General Rule: Catches shall be returned to the marine environment whenever safety conditions and the condition of the specimen allow it.
  • Atlantic Bluefin Tuna: Specifically and without exception, any catch of Atlantic Bluefin Tuna (Thunnus thynnus) shall be considered accidental and subject to a strict catch-and-release policy. It must be returned to the sea immediately in all cases, handled with extreme care to ensure its survival.
